Welcome to Pokenight (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website and services (the “Site”). By accessing or using the Site, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use the Site.

1. Eligibility

By using this Site, you confirm that:

You are using the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

2. Products and Services

Pokenight sells official, authentic, and sealed Pokémon Trading Card Game (TCG) products.

Due to the nature of collectible trading card products:

All card contents and pull rates are randomised

No guarantees are made regarding specific cards, rarities, pull rates, or market value

Product images are for illustrative purposes only

All products are sold as collectibles, not as investment products.

3. Pricing and Payment

All prices are displayed in British Pound Sterling (GBP £)

Prices may change at any time without prior notice

Payment must be completed in full before an order is processed

All payments are securely processed by third-party payment providers.
Pokenight does not store full payment card details.

4. Orders and Acceptance

An order is considered accepted once payment has been successfully processed and an order confirmation email has been sent.

Pokenight reserves the right to:

Refuse or cancel any order

Limit quantities per customer

Cancel orders due to pricing, listing, or stock errors

Cancel orders suspected of fraud, abuse, or unauthorised activity

If an order is cancelled after payment, a full refund will be issued.

5. Shipping and Delivery

Shipping methods, carriers, costs, and estimated delivery times are displayed at checkout.

Delivery times are estimates only and may vary due to carrier delays, peak periods, customs processing, or circumstances beyond our control.

Pokenight is not responsible for delays caused by shipping carriers.

6. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy.

In summary:

Only unopened, unused, and sealed products may be eligible for return

No refunds are issued for opened products or dissatisfaction related to card pulls

Randomised contents are not grounds for return

Please review the full Return & Refund Policy before making a purchase.

7. Risk of Loss

Risk of loss or damage passes to the customer once the order has been handed over to the shipping carrier, in accordance with UK consumer law.

This does not affect your statutory rights in the event of loss or damage in transit.

8. Intellectual Property

All content on the Site, including text, images, logos, designs, branding, and layout, is the property of Pokenight, unless otherwise stated.

Pokémon, Pokémon Trading Card Game, and all related names, images, and trademarks are the property of Nintendo, Game Freak, and The Pokémon Company International.
Pokenight is not affiliated with, endorsed by, or sponsored by these entities.

9. Prohibited Use

You agree not to:

Use the Site for unlawful purposes

Attempt to interfere with the Site’s security or functionality

Copy, reproduce, or exploit Site content without authorisation

Engage in fraudulent, abusive, or harmful behaviour

10. Limitation of Liability

To the maximum extent permitted by law, Pokenight shall not be liable for:

Indirect, incidental, or consequential damages

Loss of profit, collectible value, or enjoyment

Delays or issues caused by shipping carriers

Nothing in these Terms excludes or limits liability where it would be unlawful to do so under UK law.

Our total liability is limited to the amount paid for the order concerned.

11. Indemnification

You agree to indemnify and hold Pokenight harmless from any claims, damages, losses, or expenses arising from your misuse of the Site or breach of these Terms.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to the Terms

Pokenight reserves the right to update or modify these Terms at any time.
Changes take effect immediately upon posting on the Site.

Continued use of the Site constitutes acceptance of the updated Terms.
